Housing Finance and Business-Repair Project for Haitian ...

PORT-AU-PRINCE, Haiti ? February 27, 2013 ? (RealEstateRama) ? A project poised to deliver affordable home finance and business repair loans to more than 4000 Haitian families affected by the 2010 earthquake moved a step closer to reality today with the signing of a loan agreement between the Overseas Private Investment Corporation (OPIC) and a U.S. small business.

Combining $17 million in financing from OPIC, a $6 million grant from the U.S. Agency for International Development (USAID), and $3 million from the Clinton Bush Haiti Fund, the Haiti Housing Facility will create three new loan products for low-income borrowers, to be made available through Haitian non-bank financial institutions. OPIC first announced the project in October 2012.

Clive Palmer unveiled blueprints for the famously doomed ship's namesake Tuesday at the Intrepid Sea, Air and Space Museum in New York. He said construction is scheduled to start soon in China.

Palmer said 40,000 people have expressed interest in tickets for the maiden voyage, taking the original course from Southampton, England, to New York. He said people are inspired by his quest to replicate one of the most famous vessels in history.

"We all live on this planet, we all breathe the same air and, of course, the?Titanic?is about the things we've got in common," he said. "It links three continents."

The original?Titanic?was the world's largest and most luxurious ocean liner when it hit an iceberg in the North Atlantic and sank on April 15, 1912. Only 700 people of the more than 2,200 on board survived the most famous maritime disaster in history, partly because there were not enough lifeboats to carry everyone.

Palmer said an unknown when the original ship sailed ? climate change ? may play into a positive for the new ship's fate.

"One of the benefits of global warming is there hasn't been as many icebergs in the North Atlantic these days," Palmer said.

Passengers on board the replica will dress in the fashion of that period and eat dishes from the original menu, in dining rooms copied from the ill-fated predecessor.

Joining Palmer on Tuesday was Helen Benziger, the great granddaughter of?Titanic?survivor Margaret "Molly" Brown. Benziger, who agreed to serve on the advisory board for the?Titanic?II, said her great grandmother, who died in 1932, would have loved to see the?Titanic?rebuilt and complete the journey it never got to finish.

In what some may consider a temptation of fate for a remake of a notoriously "unsinkable" ship that sank, a representative of the Finnish designer of the?Titanic?II said it will be the "safest cruise ship in the world."

Markku Kanerva, director of sales for marine design company Deltamarin said that while the vessel is modeled after the legendary liner ? the diesel-powered ship will even have four decorative smoke stacks mimicking the coal-powered originals ? it will meet modern navigation and safety requirements.

In addition, plans call for a new "safety deck" featuring state-of-the-art lifeboats, safety chutes and slides. The new ship will also have amenities unknown a century ago, like air conditioning.

Palmer, who is funding construction of the ship himself, built his fortune in real estate and coal. Australia's BRW magazine estimated his net worth last year at $4 billion, although Forbes puts it at $895 million.

"I want to spend the money I've got before I die," he said. "You might as well spend it, not leave it to the kids to spend, there will be enough left for them anyway."

Winter storm slams Great Lakes region

CHICAGO (Reuters) - A powerful winter storm that buried the U.S. Plains moved on Tuesday into the southern Great Lakes region, where it snarled the evening commute in Chicago and Milwaukee, created near-whiteout conditions and forced hundreds of flight cancellations.

Wind gusts of up to 35 miles per hour (56 km per hour) hurled a potent blend of wet snow and sleet on north-central Illinois, southern Wisconsin and northern Indiana and Ohio, according to the National Weather Service.

More than 500 flights were canceled at Chicago's O'Hare International and Midway airports, according to the Chicago Department of Aviation. Those flights that managed to take off or land faced delays of up to an hour.

The Illinois Tollway agency, which maintains nearly 300 miles of highway around Chicago, deployed its fleet of more than 180 snowplows to keep the roads clear.

As the afternoon rush hour began in Chicago, blowing snow reduced visibility and created treacherous driving conditions, doubling average travel times in and out of the city on major expressways, according to Traffic.com.

The Wisconsin Department of Transportation warned that much of Interstate 94 between the Illinois state line and Milwaukee was ice covered.

In Chicago, the city's public school system, the third-largest school district in the country, canceled all after-school sporting events, including six state regional basketball games.

The snowstorm may have discouraged some voters in Chicago and its suburbs from voting in a special election primary to replace indicted Congressman Jesse Jackson Jr., who resigned the seat in November citing health concerns.

Forecasters with the National Weather Service said the storm would continue to move eastward, dumping 3 to 5 inches of wet snow on Detroit overnight and into Wednesday morning.

It is then expected to move slowly into the Northeast, largely avoiding the cities of New York, Boston and Washington, D.C., but bringing snow to parts of New York state, Vermont, New Hampshire and Maine, said Brian Korty, a meteorologist with the National Weather Service.

"It's going to linger for a long time over portions of the Northeast," Korty said.

'POTPOURRI OF WINTRY WEATHER'

Parts of New York and Pennsylvania could get a "sloppy mix" of snow, ice and rain. Already, ice accumulations were causing sporadic power outages across higher terrains of western Maryland, eastern West Virginia and far western Virginia, said Erik Pindrock, a meteorologist with AccuWeather.

"It's a very multi-faceted storm," Pindrock said. "It's a whole potpourri of wintry weather."

In Oklahoma, Texas and Kansas, where the storm hit earlier, residents were digging out.

Highways in the Texas and Oklahoma panhandles and parts of Kansas remained closed because of heavy and drifting snow.

Amarillo, Texas, saw 19 inches of snow Sunday night into Monday, the third-largest snowfall ever in that city, Pindrock said.

In Kansas, a woman died and three passengers were injured Monday night on Interstate 70 when their pickup truck rolled off the icy roadway in Ellis County, Kansas Governor Sam Brownback said. Earlier Monday, a man was killed when his car veered off the interstate in Sherman County near the Colorado border, he said.

"We urge everyone to avoid travel and be extremely cautious if you must be on the roads," said Ernest Garcia, superintendent of the Kansas Highway Patrol.

A 58-year-old man and his 69-year-old sister died from carbon monoxide poisoning in Kansas City, Kansas, from a gas generator being used in their home because they lost power Tuesday in the snowstorm, said Deputy Fire Chief Craig Duke.

In northern Oklahoma, one person died when the roof of a home partially collapsed in the city of Woodward, said Matt Lehenbauer, the city's emergency management director.

"We have roofs collapsing all over town," said Woodward Mayor Roscoe Hill Jr. "We really have a mess on our hands."

Kansas City, Missouri, was also hard hit by the storm, which left snowfalls of 7 to 13 inches in the metro region on Tuesday, said Chris Bowman, meteorologist for the National Weather Service. Another 1 to 3 inches is forecast for Tuesday evening and nearly two-thirds of the flights at Kansas City International Airport Tuesday afternoon were canceled.

In addition to the winter storm, National Weather Service forecasters on Tuesday issued tornado watches across central Florida and up the eastern coast to South Carolina.

Head of F-35 program says corporations milking the $396 billion project

AVALON, Australia (Reuters) - The Pentagon program chief for the F-35 warplane slammed its commercial partners Lockheed Martin and Pratt & Whitney on Wednesday, accusing them of trying to "squeeze every nickel" out of the U.S. government and failing to see the long-term benefits of the project.

U.S. Lieutenant-General Christopher Bogdan made the comments during a visit to Australia, where he has sought to convince lawmakers and generals to stick to a plan to buy 100 of the jets, an exercise complicated by the second grounding of the plane this year and looming U.S. defense cuts.

Pratt & Whitney, a unit of United Technologies Corp , is sole supplier of engines to the $396 billion F-35, or Joint Strike Fighter. Lockheed Martin provides the body of the radar-evading jet, the most expensive combat aircraft in history.

"What I see Lockheed Martin and Pratt & Whitney doing today is behaving as if they are getting ready to sell me the very last F-35 and the very last engine and are trying to squeeze every nickel out of that last F-35 and that last engine," Bogdan told reporters at the Australian International Airshow in southern Victoria state.

"I want them both to start behaving like they want to be around for 40 years," he added. "I want them to take on some of the risk of this program, I want them to invest in cost reductions, I want them to do the things that will build a better relationship. I'm not getting all that love yet."

A Lockheed Martin executive at the airshow declined to comment when reached by Reuters, saying he was unaware of Bogdan's comments. Executives from Pratt & Whitney could not immediately be reached for comment.

Bogdan caused a stir shortly after joining the F-35 program last August when he described the relationship between the government and Lockheed Martin as the worst he'd ever seen. There had been little improvement since then, he said.

"Are they getting better? A little bit," he said. "Are they getting better at a rate I want to see them getting better? No, not yet."

If the project stays on track, Pratt & Whitney will eventually provide 4,000 engines and Lockheed Martin 3,000 planes.

The Pentagon plans to buy 2,443 of the warplanes in the coming decades, although many analysts believe U.S. budget constraints and deficits will reduce that number.

Australia, a close American ally, is considering doubling its fleet of 24 Boeing Co F/A-18 Super Hornets amid delays and setbacks in the F-35 project. That means Canberra could buy far fewer F-35s than initially planned.

LEAKS

Bogdan was also critical of what he suggested were leaks from Pratt & Whitney's camp about the engine issue, which led the Pentagon to suspend F-35 flights last Friday.

Two sources told Reuters that Pratt & Whitney is 99 percent sure the fan blade problem that grounded the jets was not caused by high-cycle fatigue, which could force a costly design change, and the aircraft could be flying again within the week.

"Until all those tests are done and I see the results, I don't know what's going on," Bogdan said. "However ... my gut would tell me it's on the spectrum of the minor side - 99 percent is bold, flying next week is bold."

Bogdan also gave the example of taking six months to close a deal with Pratt & Whitney for engines on its fifth bloc of jets, shortly after General Electric Co had been dropped as a second supplier of engines for the program, leaving Pratt & Whitney as sole supplier for the next 40 years.

"Now, you would think a company like Pratt & Whitney that was just given the greatest Christmas gift you could ever, ever get for a company would act a little differently," Bogdan said.

Bogdan is flying back to the United States this weekend, just in time to hear about the future of U.S. military budgets, which are slated to be cut by nearly $500 billion over the next decade, an amount which could double unless Congress acts in the next week to avert spending reductions known as "sequestration".

Bogdan said he was confident the F-35 program would remain on track and on budget if he was given the discretion to deal with any cuts.

The risk is that money is cut from the $6 billion set aside for the development program by the end of October next year.

"I need every penny of that $6 billion to get over the finish line," Bogdan said. "If they take money out of development something's going to have to give. I'm either going to have to push the program out or I'm going to have to shed capability."

Budget cuts aside, Bogdan said he was confident of bringing the cost of each plane down to around $90 million by 2013, compared to around $120 million now.

Budget cuts have already forced Italy to scale back its F-35 orders, and Turkey has delayed its purchases by two years. Orders from Japan and Israel have buoyed the project, and additional Israeli orders are expected in 2013.

Lockheed is building three different models of the F-35 for the U.S. military and eight countries that helped pay for its development: Britain, Canada, Italy, Turkey, Denmark, the Netherlands, Australia and Norway.

It?s winter. Generally, it?s cold and gray, though here in Memphis, the months are punctuated with weirdly frustrating days of 70 degree F. weather. I love winter food, but I have souped and stewed and braised myself silly and I?m ready for something lighter and fresher. This recipe started as just that. A quick whip-up with the last citrus at the bottom of the fruit bowl and some shrimp from the freezer.? But this good enough to share, and could not be a quicker family meal or company dish.

Big juicy shrimp remind me of summer, and citrus is sometimes the one spot of sunshine in the winter foodscape. Add a little garlic and fresh, leafy parsley and this is a bright, sunny dish. A touch of cream adds some body, but mostly this sauce just glazes the pasta and shrimp with zest. Use a high-quality olive oil to make sure the citrus really shines.

Citrus Shrimp Linguine

Serves 4

12 ounces linguine

1 orange

1 lemon

1 lime

3 garlic cloves

1/2 cup extra virgin olive oil

1/4 cup heavy cream

Small handful flat leaf parsley leaves, plus more for sprinkling

1 pound shrimp, peeled and deveined

Salt and pepper, to taste

Cook the linguine in a pot of well-salted water according to the package instructions. Drain the pasta, reserving a little of the cooking water.

Grate the zest of the orange, lemon, and lime into the carafe of a blender. Juice the citrus to produce 3/4 cup juice combined. Add the juice to the blender with the garlic, parsley, olive oil, cream, 1 teaspoon salt, and a few grinds of black pepper. Blend until smooth.

Pour the sauce into a large skillet or pot that will hold the pasta. Bring to a boil and cook for about 5 minutes until the sauce is slightly thickened. Add the shrimp and cook, turning once, until cooked through. They will be pink, firm, and curled tightly. Immediately add the pasta to the pot and a couple of tablespoons of cooking water. Use tongs to toss everything together, coating all the pasta with the sauce.

Serve immediately sprinkled with a little chopped fresh parsley.

A New York assemblyman who at first vigorously defended wearing blackface, an Afro wig and a basketball jersey to a costume party apologized Monday, saying he didn?t mean to hurt anyone.

Democratic Assemblyman Dov Hikind wore the basketball garb at his own party in his home to celebrate the Jewish holiday of Purim, for which costumes are commonly part of the celebration. For hours on Monday, Hikind was assailed by criticism that he initially dismissed as ?political correctness to the absurd.?

At a news conference outside his Brooklyn home, however, Hikind pledged to be ?a little more careful, a little more sensitive.? He added: ?I repeat, it was not meant to in any way hurt anyone. And those that were? I?m sorry. That was not my intention.?

Assemblyman Karim Camara of the state Black, Puerto Rican, Hispanic & Asian Legislative Caucus had called Hikind?s actions at the party ?callous and repugnant.?

?It brings back the memories of African-Americans being reduced to buffoonery just to gain access to the entertainment industry,? said Camara, who is also a Brooklyn Democrat and a black leader in the New York state Legislature.

The powerful leader of the Democrat-led Assembly, Speaker Sheldon Silver, weighed in shortly after Hikind?s news conference, calling Hikind?s actions ?inappropriate and offensive.? No action against Hikind was announced.

Earlier this month, Hikind criticized the fashion designer John Galliano, who was recently photographed in New York City dressing as a Hasid with a long jacket and curly sidelocks. Two years ago, Galliano was fired from Christian Dior after his anti-Semitic rant was caught on video.

Hikind demanded an explanation from Galliano for his costume.

?If it was just anyone else, I wouldn?t know what to say. But considering who this guy is, considering his background and what he?s said in the past, let him explain it to all of us: Are you mocking us?? Hikind told the New York Post.

On Jan. 31, Hikind asked the president of Brooklyn College to resign for failing to stop an event he said had a racist agenda. He wrote on his blog at the time that the ?BDS Movement Against Israel? event called for a unilateral boycott against Israel and Israeli businesses.

In Albany, Hikind has championed some conservative and religion-based issues. In 2009, he opposed an early vote to legalize same-sex marriage

?It is about what I believe God wants,? Hikind said then. ?God doesn?t flip-flop on an issue.?

Workers at a dying French tire factory who've become the butt of American jokes are staging a day of last-ditch protests to try to save their jobs. The protests in the northern city of Amiens come after efforts to find a new buyer for the struggling plant have fizzled. An American executive who considered buying it sent a letter last week to the French government saying that France's economic model is too worker-friendly and discourages investment. (AP) ? Workers at a dying French tire factory who have become the butt of American jokes staged a last-ditch protest on Tuesday to defy anyone ? plant owner Goodyear, prospective buyers, even the French government ? to try and take their jobs away.

They've been fighting for 62 months to keep the factory operating and prevent Goodyear from shifting work to China. But their efforts seem doomed as a labor model that features high wages, long vacations and short work weeks is increasingly being called into question amid a weak economy.

It's a growing problem across France, particularly as the Socialist government of President Francois Hollande is under pressure from the European Union and financial markets to focus on cutting debt, rather than trying to prop up loss-making industries.

The protests at the plant in the northern city of Amiens came after efforts to find a new buyer for the struggling factory fizzled. The most promising prospect, an American executive, sent a letter last week to the French government saying that the country's economic model is too worker-friendly and discourages investment.

The factory's closure was announced five years ago by Goodyear when workers refused to accept any layoffs. It will be at least 2014 before the French government intervention runs its course and the plant ultimately shuts down.

"I have visited that factory a couple of times. The French workforce gets paid high wages but works only three hours. They get one hour for breaks and lunch, talk for three and work for three. I told this to the French union workers to their faces. They told me that's the French way!" Maurice Taylor, the CEO of Titan tires, wrote to the French government official trying to find a buyer. "How stupid do you think we are?"

The stinging letter infuriated France's political class and even drew a rebuke from the director of Goodyear France, who insisted that the accusations against the workers he's trying to lay off were "unfair."

"It is logical that companies make money. It is their first goal. But at some point, they also must divide the wealth fairly," said Mickael Wamen, a union leader at the factory who organized Tuesday's protest.

Figures from the Organization for Economic Co-operation and Development show France has one of the highest rates of productivity ? measured as economic output per hour worked ? in Europe. In fact, it is close to that of the U.S.

But that productivity rate in France also costs more because of higher taxes for companies. As a result, analysts and politicians say France, the continent's second-largest economy after Germany, is rapidly losing its competitiveness.

For weeks now, French government officials have hinted, warned and then finally outright acknowledged that the country was going to miss its EU-mandated deficit targets, that unemployment was certain to rise even beyond the current 10.7 percent, and that drastic spending cuts were going to hit every city and town for years to come.

Hollande was blunt on Saturday as he warned both European authorities and the French that things would get worse before they improved.

"2013 will be marked by more unemployment," he said.

Stephen Lewis, chief economist for Monument Securities, said Hollande's options were dwindling fast and was relying on the EU's leniency on deficit targets. The EU expects France's budget deficit to be 4.6 percent of annual GDP in 2012, well above the bloc's 3 percent target.

"His short-term option is to try to persuade the EU authorities to give him more leeway. Then he'll be able to continue with his budgetary policies and not impose more austerity on what already is an austere situation," Lewis said. "The moment that the EU acknowledges France has a problem is the moment when we have a major euro crisis."

For Amiens, with an unemployment rate at 12.5 percent and rising faster than all but one region in France, the future is here.

"Our country ? like Europe in general ? is on the verge of a social explosion," said Wamen, the union leader. "These who don't listen to the people, who don't listen to the rising anger are, in my opinion, dangerous arsonists because I think we are on the verge of a social explosion."

For Peter Morici, a conservative economist at the University of Maryland, the French need to come to terms with the fact that both their own economic model and that of the European Union have failed them.

"If they cut spending the economy will start to shrink. If they don't cut spending, they will go bankrupt," he said. "The realization is emerging in Europe that Europe is not going to get better."

Morici said it's clearly too late for countries like Greece, Spain and even Italy, where this week's elections called into question the country's very ability to govern itself. And France is out of options, he added.

That realization appears to be sinking in already in Amiens, despite the workers' promises to sue Goodyear and Titan and find a way to keep the factory going.

After a brief protest in the morning, they took a few hours off in the middle of the day before staging another demonstration march. But by mid-afternoon, all but a few dozen of the workers had trickled away, and only a handful returned to the parking lot to burn tires. Those, at least, were easy to find.

Warrant issued for Vegas Strip shooting suspect

LAS VEGAS (AP) ? Police said Monday they have a warrant for a 26-year-old ex-convict identified as the prime suspect in a shooting and fiery crash that killed three people last week on the Las Vegas Strip.

"We can say with certainty that Ammar Harris is the suspect who fired the fatal shots," Las Vegas police Capt. Chris Jones told reporters at an afternoon update about a manhunt that he said would be advertised on southern Nevada billboards.

Police previously released a photo of Harris taken after his arrest last year in Las Vegas in a 2010 prostitution case. It showed Harris with tattoos on his right cheek and words on his neck above an image that appeared to depict an owl with blackened eyes. Jones said Harris should be considered armed and dangerous.

Jones said investigators were looking everywhere Harris had lived in the past. He wasn't specific.

Public records show that Harris previously lived in South Carolina and Georgia, and told a police officer when he was arrested in Miami Beach last December that he had lived in Florida for about a year.

Harris was convicted in 2004 in Orangeburg, S.C., of felony possession with intent to sell a stolen pistol, Jones said. The conviction was not in California, as police said earlier.

Clark County District Attorney Steve Wolfson attended the news conference and said afterward that the case was getting top priority from prosecutors and he hoped Harris would turn himself in. He said the warrant was issued Friday.

"If Mr. Harris is listening, I would urge him to surrender," Wolfson said.

Harris used the name Ammar Asim Faruq Harris when he was arrested last May in Las Vegas in the June 2010 case. He was charged with robbery, sexual assault, kidnapping and coercion with a weapon.

Las Vegas police also sought pandering by force and ex-felon in possession of concealed weapon charges stemming from allegations that Harris was a pimp and attacked a woman.

Court records show the case was dismissed last June. The prosecutor and a public defender who handled the case didn't immediately respond to messages Monday.

In Miami Beach, Harris was arrested Dec. 7 after he was accused of driving a silver 2006 Hummer H3 the wrong way on a congested street at 2 a.m. The arresting officer said Harris produced a Florida state identification card and provided a Miami address. The status of the case in Miami-Dade courts was unclear Monday.

In Atlanta, Harris was arrested in June 2004 on a felony marijuana possession with intent to distribute charge. According to court records, he pleaded guilty to a misdemeanor marijuana possession charge and was sentenced to three months in jail.

Fulton County jail records show Harris spent about two weeks in jail in February 2008 after a misdemeanor battery arrest. The outcome of that case was not immediately clear Monday.

In Las Vegas, investigators say Harris was driving a black Range Rover SUV when he fired shots into a Maserati before dawn Thursday, killing an aspiring rapper and causing a crash that killed two people when the Maserati slammed into a taxi that exploded in a fireball at the heart of the Strip.

Police said several other people were with Harris in the SUV as it fled the scene of the six-vehicle, chain-reaction crash on Las Vegas Boulevard near the Bellagio, Caesars Palace, Bally's and Flamingo resorts.

Jones and police homicide Lt. Ray Steiber said they were confident that Harris was the only shooter. They didn't say whether police intend to prosecute anyone else in the SUV.

But, "To anyone who is aware of his location or is assisting Ammar Harris in any way, you will be arrested and prosecuted," Jones said. "You may think you're being a friend, but keep in mind Ammar Harris is wanted for the murder of three citizens."

The SUV was the focus of an intense search before it was found Saturday parked in the garage of a gated apartment complex just a couple of blocks east of the Strip. Harris wasn't found at a nearby apartment where he was believed to have been living.

Kenneth Wayne Cherry Jr. was mortally wounded when the dark gray Maserati he was driving was peppered by gunfire from the SUV. Taxi driver Michael Boldon, 62, of Las Vegas, and passenger Sandra Sutton-Wasmund, 48, of Maple Valley, Wash., died in the taxi.

Police say the triple homicide stemmed from an altercation between Cherry and Harris in a valet area of the upscale Aria resort a block south of the crash scene at Las Vegas Boulevard and Flamingo Road.

A passenger in the Maserati was wounded in the arm, and four people from four other vehicles were treated for non-life-threatening injuries after the crash.

Las Vegas police sought help during last week's search for the Range Rover from local and federal authorities in Nevada and neighboring states of Arizona, California and Utah.

Can escape clause save voting rights provision?

WASHINGTON (AP) ? The Obama administration and civil rights groups are defending a key section of the landmark voting rights law at the Supreme Court by pointing reformed state, county and local governments to an escape hatch from the law's strictest provision.

The Voting Rights Act effectively attacked persistent discrimination at the polls by keeping close watch, when it comes to holding elections, on those places with a history of preventing minorities from voting. Any changes, from moving a polling place to redrawing electoral districts, can't take effect without approval from the Justice Department or federal judges in Washington.

But the Voting Right Act allows governments that have changed their ways to get out from under this humbling need to get permission through a "bailout provision." Nearly 250 counties and local jurisdictions have done so; thousands more could be eligible based on the absence of recent discriminatory efforts in voting.

The viability of the bailout option could play an outsized role in the Supreme Court's consideration of the voting rights law's prior approval provision, although four years ago, conservative Justice Clarence Thomas said the prospect of bailing out had been "no more than a mirage."

The court will hear arguments Wednesday in the case, which is among the term's most important, in a challenge from Shelby County, Ala.

Opponents of the law say they no longer should be forced to live under oversight from Washington because the country has made enormous racial progress, demonstrated most recently by the re-election of President Barack Obama. They object in particular to the 40-year-old formula by which some jurisdictions, most in the Deep South, are swept under the law and others remain outside it.

The administration and its allies acknowledge that there has been progress. But they say minority voters still need the protection the law affords from efforts to reduce their influence at the polls. Last year, federal judges in two separate cases blocked Texas from putting in place a voter identification law and congressional redistricting plan because they discriminated against black and Hispanic residents.

Obama himself talked about the case in a radio interview last week. He told SiriusXM host Joe Madison that if the law were stripped of its advance approval provision, "it would be hard for us to catch those things up front to make sure that elections are done in an equitable way."

Also, the law's defenders say places that have changed their ways can win release from having to get Washington's blessing for election changes. Governments seeking to exit have to show that they and the smaller jurisdictions within their borders have had a clean record, no evidence of discrimination in voting, for the past 10 years.

Shelby County has never asked to be freed from the law, but would seem to be ineligible because one city in the county, Calera, defied the voting rights law and prompted intervention by the Bush Justice Department.

Yet places with a long, well-known history of discrimination probably could find their way out from under federal monitoring, according to a prominent voting rights lawyer who used to work for the Justice Department.

"Birmingham, Ala., where they used to use fire hoses on people, may well be eligible to bail out," said the lawyer, Gerry Hebert. Birmingham officials said they've never considered asking.

The Supreme Court made clear its skepticism about the ongoing need for the law when it heard a similar case in 2009. "Past success alone, however, is not adequate justification to retain the preclearance requirements," Chief Justice John Roberts said for the court. That ruling sidestepped the constitutional issue and instead expanded the ability of states, counties and local governments to exit the advance approval process.

At that point, so few governments had tried to free themselves from the advance approval requirement that, in 2009, Thomas said the "promise of a bailout opportunity has, in the great majority of cases, turned out to be no more than a mirage."

At the time, Thomas said, only a handful of the 12,000 state, county and local governments covered by the law had successfully bailed out.

The overall numbers remain low, but the Obama administration argues that "the rate of successful bailouts has rapidly increased" since the high court last took up the Voting Rights Act nearly four years ago.

In the past 12 months, 110 local governments have been freed from the requirement to show in advance that their proposed election changes are not discriminatory. Places that have won their release from coverage include Prince William County, Va., with more than 400,000 residents, and Merced County, Calif., and its 84 municipalities.

Shelby County says that even with the recent jump in bailouts, "only a tiny percentage" of governments have found their way out of oversight from Washington.

The advance approval was adopted in the Voting Rights Act in 1965 to give federal officials a potent tool to defeat persistent efforts to keep blacks from voting.

The provision was a huge success, and Congress periodically has renewed it over the years. The most recent time was in 2006, when a Republican-led Congress overwhelmingly approved and President George W. Bush signed a 25-year extension.

The requirement currently applies to the states of Alabama, Alaska, Arizona, Georgia, Louisiana, Mississippi, South Carolina, Texas and Virginia. It also covers certain counties in California, Florida, New York, North Carolina and South Dakota, and some local jurisdictions in Michigan and New Hampshire. Coverage has been triggered by past discrimination not only against blacks, but also against American Indians, Asian-Americans, Alaskan Natives and Hispanics.

The 10 covered towns in New Hampshire are poised to become the next places to win their release from the law. An agreement between the Justice Department and the state is awaiting approval from a federal court in Washington.

Critics of the law contend the Justice Department is highlighting the escape hatch and agreeing to allow places such as the New Hampshire towns to exit to try to make the entire law look more palatable to the court.

Alaska Attorney General Michael Geraghty says in his court filing in support of Shelby County that the Justice Department "commonly agrees to bailouts for jurisdictions that are not legally entitled to receive them."

But supporters of the law argue in response that the federal government's willingness to agree to free places from the need to get permission shows that the voting rights act is flexible and helps focus attention on potentially discriminatory voting schemes.

If companies ratchet up spending, that could help unleash more hiring and extend the early-year rally in stocks, which tend to rise along with business spending.

"Once businesses start spending, that really means not only are they going to be buying goods, but they're going to be hiring Americans, and those things are really what's going to be the multiplier that helps to take this recovery and move it into greater expansion mode," said Burt White, managing director and chief investment officer at LPL Financial in Boston.

Not all the money will be spent on new projects, of course. And the spending plans announced so far are only slightly above last year's average. But they comfortably exceed the expectations of analysts, whose capex forecasts fell this year.

Part of the reason may have been the dire predictions about the "fiscal cliff" late last year when analysts were putting together their capex forecasts. At least some chief executives, including DuPont's

, blamed uncertainty over U.S. government budget and tax policy for a reluctance to invest and hire.

"A number of companies said we're planning our budget cycle on worst-possible conditions," said Fred Dickson, chief market strategist, D.A. Davidson & Co. Lake Oswego, Oregon.

That companies have turned more optimistic than analysts heartens investors because it amounts to a vote of confidence in the U.S. economy, which has been hobbled by high unemployment and household debt, and now faces curbs in government spending.

Another sign of confidence is the recent flurry of merger and acquisition activity. The $173 billion in U.S. deals announced so far in 2013 is more than double the volume seen last year at this time, according to Thomson Reuters Deals Intelligence.

After the financial crisis began in 2007, companies slashed expenses and jobs, and they remained diligent about keeping costs down even as the economy exited recession in mid-2009.

Federal Reserve data shows non-financial U.S. companies had $1.7 trillion of liquid assets, or cash, on their books as of the end of the third quarter of 2012.

MOVING OFF THE SIDELINES

The U.S. economy grew at a 2.2 percent clip in 2012 and is expected to slow to 1.9 percent this year as higher payroll taxes and government spending cuts take a bigger bite. Yet even with the economic outlook cloudy, things seem to be changing.

Of the S&P 500 companies that have issued capex guidance so far in 2013, 66 percent have spending plans that exceed analysts' expectations, the Thomson Reuters analysis showed. That's up from 57 percent in 2012, 59 percent in 2011, 55 percent in 2010, and 40 percent in 2009.

Those that have issued guidance are expecting to spend $1.59 billion on average in 2013. While that's only a modest increase from the 2012 average of $1.57 billion, it is above the analysts' estimates. Those estimates went down, to $1.48 billion in 2013 from $1.51 billion on average in 2012.

The 2013 data is based on 221 companies that have reported, while the 2012 average was based on guidance from 279 firms.

"I think companies are getting a little bit more urgency to actually go ahead and proceed with their plans despite some of the remaining uncertainties around the fiscal cliff," said Natalie Trunow, chief investment officer of equities at Calvert Investment Management whose firm manages about $13 billion in assets. "They have to remain competitive long term."

Some large firms, including Apple , have already announced plans to increase capex, and sectors with the highest percentage of companies exceeding capex estimates so far in 2013 include health care, consumer discretionary and energy, the Thomson Reuters data showed.

To be sure, some expenditures will go toward maintenance of existing equipment rather than new plants, said S&P analyst Howard Silverblatt.

Clearly some will also be overseas. But there has been a surge in investment in oil and gas production in the United States, and there are signs that some manufacturing is returning, thanks to the promise of a cheaper energy supply.

Apple, the biggest U.S. company by market capitalization, said it will spend $10 billion on capital improvements this year, about $2 billion more than last year. It ranked sixth in terms of capex projections for 2013.

Oil and gas producer Chevron tops the list with about $33.4 billion of capex planned, followed by AT&T , ConocoPhillips , Wal-Mart and Intel , the Thomson Reuters data showed.

This spending could be crucial at a time when consumer and government spending are likely to decline. A rise in the payroll tax, higher gasoline prices and a delay in tax refunds slowed retail sales in January, a worrisome sign for the year. At the same time, a slate of across-the-board government spending cuts are set to take effect on March 1, barring a deal between the White House and Congress.

PROFIT MARGINS VULNERABLE?

Of course, big capital expenditures can take a toll on earnings. And investors have worried about the effect slower profit growth could have on the stock market, which started 2013 on a tear and briefly notched a five-year high.

Energy and other commodity areas have had big increases in capital spending over the last decade, a trend that could eventually hurt margins, said Vadim Zlotnikov, chief market strategist for AllianceBernstein in New York.

"I expect this very aggressive capital spending to create the type of cost inflation that would make it very difficult for profit margins to expand," he said.

But John Carey, portfolio manager at Pioneer Investment Management in Boston, said the positives tend to outweigh the negatives. "There's always a risk when companies invest, but without investment there can't be any long-term growth." (Reporting by Caroline Valetkevitch; Editing by Steven C. Two-Time Cancer Survivor says Her Dog Helped Her Battle

Play time at the dog park meant just a little bit more for these dogs.

"We're here to bark back. We want to fight cancer," said Bark for Life chair Rebecca Ivey.?

And barking against cancer is exactly what they were doing. Camp Barkeley was filled with canine cancer survivors and caregivers. To give back to man's best friend in a way Relay for Life events never could.

"One major aspect of cancer patient's lives was missed in that," Ivey explained. "And that is the caregivers that are canine. So, we're out here just to get together, bring these puppies together and acknowledge what they do for us."

"I think pets have an unknown sense of understanding just to be there for you," said Megan Clifton.

But for one cancer survivor, Saturday was about honoring her dog, Maggie, who is a big reason to why she survived her second battle against cancer.

"I was on bed rest for about three weeks, and she never left my side. She stayed in bed with me all day," Clifton said.

She is a two-time cancer survivor. Though Maggie was only with her the second time, Megan tells me that having her little best friend fighting alongside her made it easier.

"It's so nice to have her, and it's so comforting.? She just knew when I was sick and knew how to take care of me in a way that people couldn't,"Clifton said.?

Their battle together created a strong bond, proving that Maggie is more than just a pet.

"She is my best friend," Clifton explained. "And I know that might sound crazy to some people, but i do love her. She's great, and we have a very special bond."

And those best friends are proving that barking back really can help eliminate cancer.

Iran says it has captured a foreign 'enemy drone'

TEHRAN, Iran (AP) ? Iran's powerful Revolutionary Guard said Saturday that it had captured a foreign unmanned aircraft during a military exercise in southern Iran.

Gen. Hamid Sarkheili, a spokesman for the military exercise, said the Guard's electronic warfare unit spotted signals indicating that foreign drones were trying to enter Iranian airspace. Sarkheili said Guard experts took control of one drone's navigation system and brought it down near the city of Sirjan where the military drills began on Saturday.

"While probing signals in the area, we spotted foreign and enemy drones which attempted to enter the area of the war game," the official IRNA news agency quoted the general as saying. "We were able to get one enemy drone to land."

Sarkheili did not say whether the drone was American.

In Washington, a CIA spokeswoman declined to comment on the report.

Iran has claimed to have captured several U.S. drones, including an advanced RQ-170 Sentinel CIA spy drone in December 2011 and at least three ScanEagle aircraft.

State TV said the Guard's military exercise, code-named Great Prophet-8, involved ground forces of the Guard, Iran's most powerful military force. State TV showed tanks and artillery attacking hypothetical enemy positions. He said various systems, including unmanned planes that operate like suicide bombers, were tested.

"Reconnaissance as well as suicide drones, which are capable of attacking the hypothetical enemies, were deployed and their operational capabilities were studied," the semi-official Fars news agency quoted him as saying.

Bail decision looms for 'Blade Runner'

The prosecution revealed what they call inconsistencies in Oscar Pistorius' defense, further complicating a hearing that has been full of discrepancies. But the prosecution is now facing a surprising hurdle after discovering the chief police investigator is facing charges of attempted murder, damaging his credibility and raising questions about South Africa's police force. NBC's Michelle Kosinski reports.

PRETORIA, South Africa -- A judge is likely to decide on Friday whether to grant bail to Oscar Pistorius, with prosecutors arguing he is a cold-blooded killer and his own lawyers that he is far too famous to have any chance of fleeing prosecution.

Defense lawyers for Pistorius say the athlete shot dead his girlfriend only by terrible mistake, and deserves bail to prepare for a case that has garnered global attention and has been marred by a bungled police investigation.

The so-called "Blade Runner", whose lower legs were amputated in infancy, has become an even more globally recognized figure since he killed model Reeva Steenkamp, 29, early on Valentine's Day at his home.

Prosecutors have told the court it was a premeditated murder, with Pistorius firing four shots through a locked toilet door at a cowering Steenkamp on the other side. She was hit in the head, arm and hip.

Witnesses said they heard a gunshots and screams from the home in a gated community surrounded by 3-yard high stone walls and topped with an electric fence.

Pistorius contends he was acting in self-defense, mistaking Steenkamp for an intruder and feeling vulnerable because he was unable to attach his prosthetic limbs in time to confront the threat, he said in an affidavit read in court.

The 26-year-old said he grabbed a 9-mm pistol from under his bed and went into the bathroom.

Pistorius described how he fired into the locked toilet door in a blind panic in the mistaken belief that the intruder was lurking inside.

Bail hearings in South Africa allow for prosecutors and defense lawyers to lay out their basic arguments, based on preliminary evidence.

The arrest of Pistorius stunned millions who watched in awe last year as the Olympic and Paralympic sprinter reached the semi-final of the 400 meters at the London 2012 Olympics.

In South Africa, Pistorius was seen as a rare hero who commanded respect from both blacks and whites, transcending the racial divides that persist 19 years after the end of apartheid.

Police investigating Pistorius pulled their lead detective off the athlete's case on Thursday after it emerged he himself faces attempted murder charges for shooting at a minibus.

Housing prices rise in 53 of 70 Chinese cities

RECOVERY in the housing sector continued to gather pace across the country with more than 70 percent of major Chinese cities recording monthly and yearly gains in January, the National Bureau of Statistics said today.

Excluding government-subsidized affordable housing, prices rose from a month earlier in 53 of the 70 cities tracked by the bureau, compared to 54 in December. Prices were flat in seven cities while the remaining 10 registered declines.

Shenzhen in Guangdong Province led the gains with a monthly increase of 2.2 percent, followed by a 2.1 percent jump in Beijing and a 2 percent rise in Guangzhou. That compared with a maximum gain of 1.2 percent in December.

Shanghai housing prices gained 1.3 percent, up from a 0.7 percent increase in December.

Year on year, new home prices rose in 53 of the 70 cities, with a maximum gain of 4.7 percent. That compared to 40 in December, when the biggest increase was 2.4 percent.

"More developers started to offer smaller discounts or even canceled them amid the improving buying sentiment while a growing number of home seekers decided to stop waiting for prices to drop," said Liu Jianwei, a senior statistician at the bureau. "However, I don't see a huge rebound in home prices as the government reiterated its vows to fight housing speculation."

The State Council said on Wednesday its policy to curb housing speculation while supporting owner-occupier demand will remain as home supplies are inadequate in large cities as urbanization accelerates.

In the latest move, China's cabinet asked local governments to vigorously enforce existing austerity measures, which include home purchase restrictions and differentiated credit and tax policies, and expand a property tax trial to more cities. It also said tightening measures should be implemented if prices rise notably fast in areas without restrictions.

The statistics bureau's data also pointed to a similar trend in the existing home market with 51 cities seeing month-on-month price increases in January, compared to 46 in December. The number of cities where prices gained from a year earlier also rose from 25 in December to 36 last month.

Standard & Poor's Ratings Services, which monitors dozens of real estate developers across the country, said earlier this week that it expects overall property prices to rise about 5 percent this year. S&P has also revised its outlook for the industry to stable from negative amid more favorable operating and financing conditions for developers.

Don't worry, Congressional pay is protected from 'sequester' cuts

Congressional staffers face layoffs and furloughs in two weeks, but Congress members made sure their own paychecks were safe when passing the ?sequester law? in 2011.

Technically, the mandatory cuts to military and domestic federal spending are part of the Budget Control Act of 2011. The act contained a ?poison pill??the threat of stark budget cuts by January 2013 in the form of what?s known as the sequester.

That threat was pushed back to March 1, 2013, as part of a compromise made in January. But now, barring a last-second deal, it looks like the sequester will happen.

The sequestration of funds requires that most government agencies cut their budgets by the same percentage across the board. Currently, the cuts add up to $1.2 trillion over a decade.

Right now, non-military government agencies need to cut their costs by 8.2 percent starting on March 1, 2013. Defense branches will have to cut costs by 9.4 percent. (Those percentages could be lower for the first year of cuts.)

Last fall, President Barack Obama?s administration gave a detailed report, via the Office of Management and Budget, about which agencies had to cut costs?and which government folks were exempt.

?The number of Federal Bureau of Investigation agents, Customs and Border Patrol agents, correctional officers, and federal prosecutors would be slashed. The Federal Aviation Administration?s ability to oversee and manage the Nation?s airspace and air traffic control would be reduced,? said the OMB.

Included in the mandatory cuts are expenses the members of Congress use to hire and maintain their staffs. In all, the operational expenses for Congress add up to $133 million annually.

Staffers face 22 days of furloughs, which add up to about a 20 percent pay cut for them, and layoffs lurk as a possibility.

Unless, of course, you are an actual member of Congress. Your pay can?t be cut as part of the 2011 Budget Control Act.

So why are the ?bosses? in Congress not suffering with the staff, at least not until later this spring?

The 27th Amendment to the Constitution forbids Congress from changing its own pay during a current? term of Congress. The sequester ?poison pill? in the 2011 Budget Control Act was scheduled to go into effect on January 2, 2013, the last day of the prior Congress.

The actual rules for who gets sequestered, and who doesn?t, are set by the Gramm-Rudman-Hollings Act of 1985, as amended. The Statutory Pay-As-You-Go Act of 2010 can also be a factor when a sequester goes into effect.

Congressional pay is just one of many programs that will be exempt from cuts. According to the Congressional Research Service, ?Most exempt programs are mandatory, and include Social Security and Medicaid; refundable tax credits to individuals; and low-income programs such as the Children?s Health Insurance Program, Supplemental Nutrition Assistance Program, Temporary Assistance for Needy Families, and Supplemental Security Income.?

Somehow, Congress found a way to delay its own pay, possibly until January 2015, by agreeing to put its pay in escrow on April 16, 2013, as part of the fiscal cliff deal. Even that act has been subject to a vigorous debate as a possible violation of the 27th Amendment, and it could be challenged if the budget deadlock drags out.
